1. Acceptance of Terms

By accessing or using WhoHoopin?!? (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

WhoHoopin?!? is a platform that helps basketball players find courts, check in at locations, organize pickup games ("runs"), and connect with other players. The Service includes features such as court listings, real-time check-ins, run scheduling, and player coordination.

3. Eligibility

You must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.

4. Account Registration

• You may register using an email and password or through a third-party provider (Google, Facebook).
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Harass, threaten, or intimidate other users
• Post false, misleading, or offensive content (court names, run descriptions, etc.)
• Impersonate another person or misrepresent your identity
• Spam or abuse the run creation or check-in features
• Attempt to gain unauthorized access to the Service or its systems
• Use automated scripts or bots to interact with the Service
• Interfere with or disrupt the Service or its infrastructure
• Submit false court locations or intentionally inaccurate information

6. User-Generated Content

You may submit content to the Service, including court locations, run details, and descriptions ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the Service.

You represent that you have the right to submit any User Content and that it does not violate any third party's rights.

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without notice.

7. Assumption of Risk

Basketball and other physical activities carry inherent risks of injury. By using the Service to find courts, join runs, or participate in games, you acknowledge and accept these risks.

WhoHoopin?!? is a coordination platform only. We do not organize, supervise, or control any physical activities. You participate in any games or activities at your own risk.

You are responsible for assessing the safety and suitability of any court or game before participating. We make no guarantees about the condition of any court, the skill level of other players, or the safety of any location listed on the Service.

8. Court Listings

Court locations are submitted by users and may not be verified. We do not guarantee the accuracy, availability, or condition of any listed court. Some courts may be on private property, have restricted hours, or require fees for access. It is your responsibility to verify that you have the right to use any court before visiting.

9. Run Organization

Run organizers may set rules for their runs, including requiring approval to join and setting player limits. Organizers have the right to approve or decline join requests at their discretion.

Joining a run does not guarantee a spot in any game. Game organization, team selection, and playing time are determined by the participants at the court, not by the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHOHOOPIN?!? AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

This includes, without limitation, any injuries sustained while playing basketball or traveling to or from any court listed on the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless WhoHoopin?!? and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.

13. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, abusive behavior toward other users, or prolonged inactivity.

You may delete your account at any time by contacting us.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Changes to These Terms

We may revise these Terms at any time by posting the updated version on this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
